What is an LPA Activation Code?

If you have created a Lasting Power of Attorney (LPA) for yourself or a loved one, you may have heard about the LPA Activation Code. This tool, designed to facilitate ease of use with the government’s online service, provides a basic overview of the LPA details.

Once your LPA is registered with the Office of the Public Guardian (OPG), it is a valid legal document. You do not need an activation code to use it. The code is an optional feature introduced as part of a new service, ‘Use an LPA aimed at helping attorneys manage the LPA more efficiently.

What Does the LPA Activation Code Do?

The LPA Activation Code is used with the government’s online platform, gov.uk, where attorneys can register their LPA details to access a basic overview. This code allows organisations and professionals, such as banks or doctors, to verify the existence of an LPA quickly if necessary.

This process does not alter the validity of the LPA itself; it simply makes it easier for those managing the donor’s affairs to confirm that the LPA is in place.

Is the LPA Activation Code Required to Use the LPA?

No, the LPA Activation Code is not required to use the Lasting Power of Attorney. Once registered, the LPA is fully valid and can be used at the donor’s request or in the event of mental incapacity. The code is an optional tool that simplifies sharing LPA details with third parties but does not impact the document’s legal standing.

Understandably, many individuals are confused. The word “activation” implies that the code is essential for activating or using the LPA. However, this is a misconception. The LPA Activation Code is only necessary to use the gov.uk online service, not to activate the document itself.

How Can You Obtain an LPA Activation Code?

  1. If the LPA was registered on or after 17 July 2020, the OPG should have included an activation key in the confirmation letter sent to the donor and attorneys.
  2. If the LPA was registered before 17 July 2020 – The attorney or donor must request an activation key from the OPG to use the online service.

Requesting an Activation Key:

  • Attorneys can apply for an activation key through the gov.uk website or by contacting the Office of the Public Guardian.
  • They will need details from the LPA, including:
  • The LPA reference number (found on the registered LPA document).
  • The donor’s name and date of birth.
  • The attorney’s name and date of birth.
