Avoiding Probate Pitfalls

Some clients or executors often wrongly assume Probate is unnecessary because there was a Will in place. In fact, numerous important steps need to be addressed by the executors at the time, including perhaps registering a trust and dealing with the Land Registry.

There needs to be an assessment for HMRC, which could also include dealing with the new Trust Registration Service. Your executors are responsible for acting correctly and lawfully when dealing with the estate. Their own assets could be at risk along with potential fines if they get things wrong.

From our experience, clients who have previously dealt with the issue of Probate are sometimes unaware that, in most cases, their matter may be more involved and, therefore, places greater personal risk on the executor's personal liability. If the Will contains any protection for property, then one of the challenges is correctly changing the title at the Land Registry to reflect the existence of the trust. Simply adding or removing individuals to the title could cause huge problems going forward.
